TERMS & CONDITIONS FOR ONLINE ARCHITECTURAL SERVICES

Welcome to BDesigner. These Terms & Conditions (“Agreement”) govern your access and use of our online architectural services through the BDesigner mobile application (“App”). By registering an account, making a payment, or accessing and using the platform, you agree to be legally bound by these Terms and Conditions.

If you do not agree to any part of these terms, you must not proceed with registration, payment, or use of our services. These terms apply to all parties involved in using the app, including clients, architects, and consultants.

1. INTRODUCTION TO OUR SERVICES

1.1 What We Offer

BDesigner is an online platform that provides a complete digital solution for residential architectural services, including but not limited to:

• 2D Floor Plans: Detailed room layouts with measurements

   

• 3D Elevation Designs: Exterior visualization of the building, including VR & AR – based previews

   

• Interior Designs: Visual presentation of internal spaces, including VR-based previews

   

• Structural Layouts: Basic framework and structure drawings (up to G+4 floors)

   

• Electrical & Plumbing Drawings: Guidelines for wiring, fixtures, and pipe layouts (up to G+4 floors)

   

• House Design Estimates: Approximate cost assessments for residential construction (up to G+4 floors)

   

Note: These services are limited to residential designs only. Commercial, industrial, or resale-oriented projects are not permitted.

1.2 Eligibility to Use the App

To access or use the BDesigner app:

• You must be at least 18 years of age.

   

• You must be a legal resident of India.

   

• Services are intended exclusively for residential building design (up to G+4 floors).

   

Violation of these eligibility requirements may result in suspension or termination of your account.

1.3 Important Disclaimers

BDesigner’s role is limited to design consultation only. We explicitly disclaim:

• Any on-site construction supervision or inspection

   

• Any guarantee regarding structural safety, construction durability, or feasibility

   

• Any local government approvals, NOCs, or permits

   

Clients are fully responsible for:

• Compliance with local building codes, zoning regulations, and engineering standards

   

• Getting local licensed engineers to verify structural safety before implementation

   

1.4 Client Registration and Responsibilities

Clients must:

• Register truthfully and provide accurate personal and project-related information, including plot size, location, design preferences, and requirements.

   

• Respond in a timely and constructive manner to submitted drafts, especially within specified feedback timelines.

   

• Maintain respectful behavior toward architects, consultants, and support staff. Any form of harassment may result in termination of service.

   

2. PAYMENT TERMS & REFUND POLICY

2.1 Payment Structure

• Clients opting for scheduled payment plans must pay 50% in advance and 50% before delivery of the final files.

   

• All payments must be made through the authorized payment gateways provided in the app. Manual payments (UPI, bank transfer, etc.) are not accepted.

   

• Applicable GST and other taxes will be shown on the invoice.

   

2.2 No Refund Policy

Once the design process has started, no refunds will be granted. Partial refunds are possible only if work has not yet commenced, with payment gateway or processing charges deducted.

Refunds are not applicable under the following circumstances:

1. Change of Mind After Design Approval

    

   • Once approved, the architect has invested professional time, and changes require a new project request.

      

2. Delays Due to Client Non-Cooperation

    

   • Failure to share measurements, preferences, or feedback on time disqualifies refund eligibility.

      

3. Dissatisfaction After Multiple Revisions Based on Personal Preference

    

   • If multiple revision rounds have been honored, no refunds will be processed on subjective dissatisfaction.

      

2.3 Allocation of Consultant and Architect

After successful payment:

• A consultant is automatically assigned to gather your requirements.

   

• The consultant reviews multiple architect profiles and selects the most appropriate architect.

   

• A manual verification process is followed before creating a project-specific group chat within the app for communication.

   

2.4 Communication and Chat Group Rules

• All communications must happen via the official in-app chat group.

   

• Off-platform communications (e.g., WhatsApp, calls) are not valid for official documentation.

   

• All chats are logged for service tracking, performance evaluation, and dispute resolution.

   

2.5 Project Timeline, Tracking, and Delivery

• Each service includes a defined project timeline, visible through in-app milestone tracking.

   

• Delays caused by architects or consultants are subject to internal review and action.

   

• Client delays in feedback can trigger project auto-completion after extended silence.

   

2.6 Project Extension and Penalty Policy

• Extensions may be granted for valid issues (plot data errors, etc.) after consultant review.

   

• Unjustified delays from either party may lead to penalties:

   

  • Architects: Ratings downgrade or temporary suspension

     

  • Clients: Project pause or cancellation after warnings

     

3. PROJECT DELIVERY, REVISIONS & MODIFICATIONS

3.1 Estimated Delivery Time

• Estimated delivery is discussed at the start of the project.

   

• Delays caused by missing/inaccurate client information are not our responsibility.

   

3.2 Revisions Policy

• Up to 3 minor revisions are included free of charge.

   

• Major changes or complete redesigns are billable separately.

   

• Clients must respect architect feedback on feasibility of changes.

   

3.3 Platform Eligibility Requirements

You must:

• Be at least 18 years of age, or have consent from a guardian.

   

• Enter valid and complete data during sign-up.

   

• Follow local laws and platform guidelines.

   

Failure to comply may result in account suspension or termination.

4. STRUCTURAL LIABILITY & RISK DISCLAIMER

4.1 No Liability for Structural Failures

We are not liable for any:

• Cracks, failures, or defects in construction

   

• Safety incidents, structural collapses, or injuries

   

• Material defects or foundation issues

   

Only a licensed structural engineer must certify the design before use.

4.2 No Liability for Execution

We do not:

• Monitor contractor performance or material quality

   

• Ensure execution accuracy of the design on-site

   

Clients must hire a qualified site engineer to manage construction.

4.3 Compliance with Local Laws

Clients must ensure:

• All government permits are obtained

   

• Building design complies with local building laws and zoning codes

   

5. FILE RELEASE & INTELLECTUAL PROPERTY RIGHTS

5.1 Watermarked Files Before Final Payment

• Only watermarked some previews are shared before full payment (Not all files showcase before Final Payment).

   

• Editable files (CAD, high-resolution images) are shared only after the final payment is cleared.

   

5.2 Copyright and Usage Rights

• All designs remain the intellectual property of BDesigner until full payment.

   

• After full payment:

   

  • Clients receive personal use rights only

     

  • Commercial resale, redistribution, or modification requires prior written permission

     

6. DISPUTE RESOLUTION & LIMITATION OF LIABILITY

6.1 Dispute Handling Process

• Clients must report any issues within 7 days of project delivery.

   

• The consultant will evaluate and propose a resolution.

   

• If unresolved, the issue is escalated to the BDesigner admin team.

   

• The final written decision will be binding on all parties.

   

6.2 Limitation of Liability

• Our total liability shall not exceed the amount paid by the client.

   

• We are not liable for:

   

  • Indirect damages

     

  • Construction delays

     

  • Third-party failures

     

  • Financial or emotional loss

     

7. ADDITIONAL POLICIES AND APPEALS

7.1 Payment Plan Modifications

• Clients may request a modified payment schedule due to financial difficulties.

   

• Requests must include valid reasoning or documentation.

   

• Consultants may approve/reject based on project status.

   

7.2 Appeal Rights

• If rejected, clients may appeal once, which will be reviewed within 6–7 business days.

   

• All post-appeal decisions are final and binding.

   

7.3 Architect Ratings and Evaluation

Clients may rate architects based on:

• Responsiveness

   

• Timeline adherence

   

• Quality of work

   

• Estimate accuracy

   

• Professionalism and satisfaction

   

Architect ratings influence future project assignments and platform rewards.

7.4 Ownership and Publicity

• BDesigner retains the right to showcase your design (unless a client requests confidentiality).

   

• Unauthorized resale, use, or modification is strictly prohibited.

   

7.5 Misuse and Account Termination

We reserve the right to suspend or terminate your account for:

• Misuse or fraudulent behavior

   

• Disrespectful conduct

   

• Repeated violations

   

• Submission of false details

   

8. GENERAL TERMS

8.1 Agreement Acknowledgment

By making payment or continuing to use our services, you confirm:

• You have read and agree to the Terms

   

• You understand refund and revision policies

   

• You accept liability limitations and usage rights

   

• You recognize that all designs must be reviewed by licensed engineers

   

8.2 Notifications & Service Updates

By using the app, you consent to receive updates via:

• Email

   

• SMS

   

• Push notifications

   

• WhatsApp (if opted in)

   

Note: You may opt out of marketing, but project updates are mandatory.

8.3 Invoicing and Taxation

• Clients receive tax-compliant GST invoices after payment.

   

• Reverse charge mechanism does not apply.

   

• Clients are not liable to deduct architect TDS; BDesigner manages it as per Section 194-O of the Indian Income Tax Act.

   

8.4 Updates to Terms

• BDesigner may amend these Terms at any time.

   

• Clients will be notified through app/email.

   

• Continued usage implies acceptance of the revised terms.

   

8.5 Governing Law & Jurisdiction

• These Terms shall be governed under Indian law.

   

• Legal proceedings are subject to courts located in Solapur, Maharashtra, where the company is registered.
